Justice for Police Inspector: Departmental Penalty Set Aside by Court
Alhamdulillah! Another significant success has been achieved in securing justice for a Police Inspector before the Honorable Court.
The employee was serving as an SHO in the Punjab Police when he was falsely accused of extending undue favor to accused persons in a murder case and maintaining unlawful connections with them. An initial inquiry was conducted by the District Police Officer (DPO), which categorically declared the officer innocent of all allegations.
However, in a surprising turn of events, a second inquiry on the same allegations was initiated at the level of the Regional Police Officer (RPO). This time, contrary to the earlier findings, the officer was awarded a departmental penalty. This action was not only unlawful but also violated the fundamental principles of justice.
The said illegal departmental proceedings were challenged before the Honorable Court. It was argued that:
- No allegation against the officer had been proven
- Conducting a second inquiry on the same set of allegations is contrary to law and fairness
After hearing the arguments from both sides, the Honorable Court allowed the appeal and set aside the departmental punishment.
This judgment not only ensures justice for the aggrieved officer but also reinforces the fundamental legal principle that no individual can be subjected to repeated proceedings on the same allegations.
