Another Victory for a Retired Employee: Court Orders Promotion, Arrears and Revision of Pension
Allah Nawaz Khosa, Advocate High Court & Service Tribunals
Alhamdulillah! Another retired government employee has successfully secured his lawful right to promotion through legal proceedings. This case is an important reminder that an employee should not be deprived of a legitimate promotion merely because the department failed to complete the promotion process before retirement.
Background of the Case
The employee was serving as a Sub-Engineer in the Irrigation Department when he became eligible for promotion in accordance with the applicable service rules. However, the department denied him promotion on the ground that he had already retired from service and, therefore, could no longer be considered eligible for promotion.
This approach was challenged before the competent judicial forum on behalf of the retired employee.
Legal Grounds for Challenging the Departmental Orders
On behalf of the employee, it was argued that he had fulfilled the prescribed eligibility criteria for promotion before his retirement. The department, however, failed to convene the Promotion Board during his service, thereby depriving him of the opportunity to be considered for promotion at the appropriate time.
It was further contended that an employee cannot be made to suffer the consequences of the department’s own failure to perform its legal and administrative duties. Where an employee becomes eligible for promotion during service, the department cannot defeat his legitimate claim simply by relying on his subsequent retirement, particularly when the delay in considering his case is attributable to the department itself.
The departmental orders refusing promotion were, therefore, challenged on the ground that the employee’s case had not been considered in accordance with the applicable service rules and the principles of fairness and justice.
Court Allows the Appeal and Grants Relief
After hearing the arguments advanced on behalf of the employee and the departmental representatives, the Honourable Court accepted the appeal and directed the department to grant the employee his due promotion.
The Honourable Court also directed the department to extend the consequential financial benefits, including:
- Grant of due promotion in accordance with the applicable service rules.
- Payment of all admissible arrears arising from the grant of promotion.
- Revision of pension in light of the promotion and the consequential benefits admissible under the applicable rules.
This decision provides substantial relief to the retired employee, whose legitimate service-related claim had remained unaddressed due to the department’s failure to consider his promotion before retirement.
Legal Significance for Retired Government Employees
The case highlights an important principle of service jurisprudence: retirement should not automatically extinguish a claim for promotion where the employee had become eligible during service and the claim remained unconsidered because of departmental delay or inaction.
Every case, however, must be examined in light of the applicable service rules, the employee’s eligibility, the relevant promotion criteria and the facts establishing whether the claim had accrued before retirement.
Retired government employees who believe they were unlawfully denied promotion may seek appropriate legal remedies for consideration of their cases and, where legally admissible, the consequential benefits, including arrears and revision of pension.
