The Lahore High Court has delivered a significant and detailed judgment regarding Rule 17-A, setting aside the judgment of the learned Single Bench and allowing the appeal in favor of the child of a deceased government employee. The Court directed the concerned department to provide employment to the petitioner under Rule 17-A.
Appearing on behalf of the employees, Allah Nawaz Khosa, Advocate High Court, argued that the legal right of the children of government employees who passed away before 24 July 2024 remains fully protected under Rule 17-A. He submitted that denying them employment is contrary to law, justice, and reflects arbitrary action by the department.
It was further argued that the department’s objection—that only the children of deceased employees are entitled to employment under Rule 17-A after the Constitutional Bench’s judgment, while the children of employees retired on medical grounds are not eligible—is legally unsustainable. Counsel contended that the applicable law grants employment rights under Rule 17-A to the children of both deceased employees and employees retired on medical grounds.
After hearing the parties, the Lahore High Court accepted the appeal, rejected all objections raised by the Government, and directed the concerned department to appoint the petitioner under Rule 17-A in accordance with law.
